Pool fence- horizontal slats allowed if tightly spaced

We like modern design and want a horizontal slat fence. We can space slats 1/2” apart and we are alternating 3” wide boards with 6” wide. It’s vinyl so they are centered on the posts not placed one one side. When I read the code it says when the horizontals are closer than 48” apart they must be on the inside where the pool is I supposed so they can’t use it as a ladder on the outside to climb in but that’s on a true wood fence.
